The earlier disputed widening work of the footpath in New Road has resumed after Patan High Court ruled in favour of KMC.
The legal dispute between the Kathmandu Metropolitan City and the Roads Division Office, Kathmandu, which had previously halted the expansion began when the Roads Division seized goods and halted the footpath expansion initiated by the Kathmandu Metropolitan City.
In response, the city filed a writ in the High Court, leading to a court order allowing the continuation of the footpath expansion. The court ruled that urban roads fall under local jurisdiction and instructed that the work should not be stopped by the Roads Division.
The Patan High Court, with Judges Dhruvraj Nand and Prakash Kharel presiding, specifically ordered that the letter from the Divisional Road Office directing the Kathmandu Metropolitan City to stop the expansion should not be enforced. Following this decision, the city resumed the expansion work on Wednesday.
The dispute had not only involved the Roads Division and Kathmandu Metropolitan City but also led to internal conflicts among the city’s wards and representatives. Additionally, traders and residents of the New Road area had protested the halt, advocating for the continuation of the footpath expansion.
